Platform Terms
Version 2026-05-30. Effective on publication. These terms govern use of the MongiKazi platform.
0. Definitions
"Platform" means MongiKazi websites, applications, and related services. "Employer" means a user requesting services. "Helper" means a user offering services. "Booking" means a platform-recorded work request and its status flow.
1. Acceptance and eligibility
By creating or using an account, you accept these terms and confirm that information you provide is accurate and current.
1.1 Age and authority
You confirm you have legal capacity to enter binding agreements, and if acting for an organization, you are authorized to do so.
2. Marketplace role
MongiKazi provides a digital platform for requests, bookings, communication, and trust signals between employers and helpers. Users remain responsible for their own conduct, legal compliance, and contractual performance.
2.1 No employment agency guarantee
Unless expressly stated in a separate written agreement, MongiKazi does not guarantee placement, earnings levels, or uninterrupted availability of users.
3. Account responsibilities
You must keep login credentials secure, not impersonate others, and not submit false, misleading, or abusive content. You are responsible for activity on your account.
3.1 Verification and profile content
Verification badges, profile data, and trust indicators may be updated, suspended, or removed where information changes or risk signals are detected.
4. Booking and payment conduct
Users must follow booking status flows, attend confirmed work responsibly, and avoid off-platform fraud, payment manipulation, or review abuse.
4.1 Cancellations, no-shows, and disputes
Late cancellations, no-shows, and material scope disputes may affect trust status and account visibility. The platform may consider communication logs and booking history when resolving disputes.
4.2 Fees and future commercial terms
Where platform fees apply, they will be disclosed in product flows or pricing pages. Updated fee structures may apply prospectively.
5. Suspension and enforcement
MongiKazi may restrict or terminate access for fraud, harassment, unsafe conduct, policy evasion, or legal non-compliance, and may preserve records for investigation.
5.1 Investigation cooperation
Users agree to provide reasonably requested information for trust and safety investigations. Refusal may result in reduced functionality or suspension.
6. Limitation and availability
Services are provided on an as-available basis. To the extent permitted by law, MongiKazi excludes liability for indirect or consequential losses arising from platform use.
6.1 Third-party dependencies
Service availability may depend on third-party infrastructure (hosting, telecommunications, payment rails). MongiKazi is not liable for outages beyond reasonable control.
6.2 Indemnity
You indemnify MongiKazi against claims arising from your unlawful conduct, policy breaches, or misuse of the platform.
7. Governing law
These terms are governed by the laws of the Republic of South Africa.
7.1 Dispute process
Parties should first attempt good-faith resolution through platform support before formal legal action, unless urgent relief is required.
8. Changes to terms
We may update these terms. Material updates will be versioned, and continued use after effective date constitutes acceptance.
